Sending a notice of infringement
If you believe content on SOFT-WHERE Games infringes a copyright you own or are authorized to enforce, send a written notice that includes all of the following (17 U.S.C. §512(c)(3)):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim is infringed (or, for multiple works, a representative list).
- Identification of the material you claim is infringing, with enough information for us to find it. The best way is the URL of the game, item, profile or group page, plus a description of the specific asset (for example, “the background music in the game at …”).
- Your contact information: name, mailing address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
When we receive a valid notice, we remove or disable access to the material promptly, and we tell the player who posted it, including a copy of the notice. Under 17 U.S.C. §512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. If you're unsure whether something infringes, consider talking to a lawyer first.
Counter-notice
If your content was removed and you believe it was a mistake or misidentification, or that you have the right to use it, you can send a counter-notice to the agent above that includes all of the following (17 U.S.C. §512(g)(3)):
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and where it appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which SeeStudents, LLC may be found), and that you will accept service of process from the person who sent the original notice or their agent.
If we receive a valid counter-notice, we forward it to the person who sent the original notice. If they don't tell us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the material within 10 to 14 business days after receiving the counter-notice. If you are under 18, a parent or guardian should send the counter-notice for you.
Repeat infringers
We keep track of valid copyright notices against each account. In appropriate circumstances, we suspend or permanently close the accounts of players who repeatedly infringe others' copyrights, and remove their content and Virtual Items, as described in our Terms of Use and Community Rules.
Trademarks and other rights
For trademark, likeness or other non-copyright complaints, email travissmith@soft-where.com with the same kind of detail: what's affected, where it is, and why. We review these under our Terms and Community Rules.
